Understanding Adult Guardianship, Part Four

Are you estate planning in Raleigh NC and aren't sure what to do about guardianship? Adult guardianship can be confusing and overwhelming when trying to understand all that it includes. We are here to help you with that.

Understanding Guardians When Estate Planning in Raleigh NC

A person petitioning to be a guardian does not have to be related to the ward, but in the case of the elderly, they often are children, grandchildren, or nieces or nephews. Someone seeking guardianship must be over 18, not have any felonies or a record of violence or dishonesty, and should not have any conflicts of interest with the ward, such as owing him or her money.
When someone petitions to oversee finances for an elderly person, it is important to ensure that the guardian will not use his or her authority to steal money from the ward. When someone has dementia or is not aware of what is going on, she could be tricked into signing checks or signing away property.
Seniors who still have some of their mental capacities may want to retain some of their rights to making decisions about certain things. During the guardianship hearing, she can appear in court with an attorney to address any issues she has with the powers that will be given to the guardian. This allows her to retain some of her authority over her life and decisions.
